I can't remember the exact name but it's an act that I believe Bill Clinton put into place to protect service members from certain things while they are overseas. Does anyone know if this act protects them from being served even if they AREN'T in a warzone?

As far as I know, this Act does not prevent military members from being served/sued while on active duty. It does require that the process serves work through specific official channels (C.O.'s, JAG, etc) It would not be fair if a person could not be sued just because he/she was a service member. That would mean that if someone were injured in an accident due to a service member, that they would not be able to recover damages. That would be unfair.

What it does do is protect the service member against is certain default judgments, where the member cannot appear in court due to inability to attend court proceedings

For the actual implications, you would probably need to speak to JAG.

My daughter is now being represented by JAG, thank goodness. Took me contacting a SENATOR to do it, though! Things are starting to move along at the pace that I am expecting it to move. Thanks!

I lost custody of my daughter due to fact, I could not appear in court in California, when I was stationed in Virginia. At the time I was called to active duty due to the 911 incident, The judge did not take any consideration even though I had my CO send a certified letter stating so. Can anyone give me advice of what I can do to have this overturned or sue the state of California?
